Consumer Rights Protection
These Terms & Conditions of the DeluxDeco.nl online store protect consumer rights. Consumers cannot waive rights granted to them by Dutch consumer law. Contract provisions less favorable to consumers than Dutch consumer law provisions are void, and Dutch consumer law provisions apply in their place.
These Terms & Conditions are not intended to exclude or limit consumer rights, and any doubts shall be interpreted in favor of the consumer.
1. GENERAL PROVISIONS
1.1 Operator of the online store

Note: DeluxDeco operates as a Polish company selling to Dutch consumers within the EU cross-border e-commerce framework. Dutch consumers retain all mandatory protections under Dutch consumer law, regardless of the choice of Polish law in these terms.
1.2 Scope of application
These Terms & Conditions apply to both consumers and entrepreneurs using the online store, unless a specific provision states otherwise.
1.3 Data protection
The Seller is the controller of personal data processed in the online store. Personal data are processed for the purposes, period, and based on grounds and principles stated in the privacy policy published on the online store website.
Use of the online store and making purchases is voluntary. Providing personal data is also voluntary, subject to exceptions stated in the privacy policy (contract conclusion and statutory obligations).
1.4 Definitions
WORKING DAY – A day from Monday to Friday, excluding public holidays in the Netherlands.
CONTACT FORM – Electronic service, an interactive form available in the online store enabling direct contact with the service provider.
ORDER FORM – Electronic service, an interactive form available in the online store enabling order placement, particularly by adding products to the shopping cart and specifying sales agreement terms, including delivery and payment method.
CUSTOMER – (1) A natural person with full legal capacity; (2) a legal person; or (3) an organizational unit without legal personality to which law grants legal capacity – who has concluded or intends to conclude a sales agreement with the Seller.
CONSUMER – A natural person acting for purposes outside their trade, business, craft or profession (Article 3:185a Dutch Civil Code).
CIVIL CODE – The Dutch Civil Code (Burgerlijk Wetboek - BW).
ACCOUNT – Electronic service, a set of resources in the service provider's IT system, marked with an individual name (login) and password provided by the user, collecting user-provided data and order information.
NEWSLETTER – Electronic service, an electronic distribution service delivered by the service provider via email, enabling users to automatically receive periodic newsletter content with product information, new products, and promotions.
PRODUCT – (1) A movable item available in the online store (including movable items with digital elements) or (2) a service (including digital and non-digital services) that is the subject of the sales agreement between customer and Seller.

ONLINE STORE – The service provider's online store available at: www.deluxdeco.nl
SELLER / SERVICE PROVIDER – DELUX DECO SPÓŁKA Z OGRANICZONĄ ODPOWIEDZIALNOŚCIĄ as specified in section 1.1.
SALES AGREEMENT – (1) A product sales agreement (for movable items), (2) a product delivery agreement (for digital content or digital service), (3) an agreement for product provision or use (for non-digital service and other products) concluded between customer and Seller via the online store.
ELECTRONIC SERVICE – A service provided electronically by the service provider to the user via the online store.
ORDER – A declaration of intent by the customer submitted via the order form and directly aimed at concluding a product sales agreement with the Seller.
2. ELECTRONIC SERVICES IN THE ONLINE STORE
2.1 Available electronic services
The following electronic services are available:
- Chat
- Contact Form
- Account
- Order Form
- Newsletter
2.2 Technical requirements
Technical requirements for cooperation with the service provider's IT system:
- Computer, laptop or other multimedia device with internet access
- Email access
- Current web browser: Mozilla Firefox, Internet Explorer, Opera, Google Chrome, Safari or Microsoft Edge
- Recommended minimum screen resolution: 1024x768
- Cookies and Javascript enabled in web browser
2.3 User obligations
The user is obliged to use the online store in accordance with law and good practices, respecting personal rights, copyrights, and intellectual property rights of the service provider and third parties.
The user is obliged to provide accurate data. The user is prohibited from providing illegal content.
3. TERMS OF CONCLUSION OF A SALES AGREEMENT
3.1 Conclusion of agreement
The sales agreement between customer and Seller is concluded after the customer places an order using the order form in accordance with section 2 of these Terms & Conditions.
3.2 Product prices
Product prices displayed on the online store website are given in euros (€) and are inclusive of VAT.
The customer is informed of:
- Total price or remuneration including taxes
- Delivery costs (including transport, delivery, or postal fees) and other costs
- If costs cannot be determined – the obligation to pay them
This information is provided on the website, including during the order process and when the customer expresses intention to be bound by the sales agreement.
3.3 Order confirmation
After placing an order, the Seller immediately confirms its receipt and simultaneously accepts the order for processing by sending an email to the customer's provided email address.
This email contains:
- Seller's statement of order receipt and acceptance for processing
- Confirmation of sales agreement conclusion
Upon customer receipt of this email, a sales agreement is concluded between customer and Seller.
3.4 Storage of agreement content
Sales agreement content is recorded, secured, and made available to the customer by:
- Making these Terms & Conditions available on the online store website
- Sending the email referenced in section 3.3
Agreement content is additionally recorded and secured in the Seller's online store IT system.
4. PAYMENT METHODS AND TERMS
4.1 Available payment methods
The Seller provides the following payment methods:
4.1.1 Bank transfer
Payment via bank transfer to Seller's bank account.

4.1.2 50% advance payment
Advance payment of 50% of the price.
4.1.3 iDEAL and other electronic payments
Electronic payments and card payments via Dutch payment service providers such as:

- Credit card (Visa, Mastercard, American Express)
- PayPal
- Bancontact (for Belgian customers)

4.1.5 Installment payments (if available)
Payment in whole or in part from a loan provided by financial institutions with which the Seller cooperates.
4.2 Payment deadlines
4.2.1 Bank transfer, electronic payment or card payment
If the customer chooses payment by bank transfer, electronic payment or card payment, the customer is obliged to make payment within 3 calendar days from the sales agreement conclusion date.
4.2.2 Advance payment
If the customer chooses advance payment, the customer is obliged to pay:
- First 50% of the price within 3 calendar days from sales agreement conclusion date
- Second 50% of the price one week before planned product delivery
5. COSTS, METHODS AND DELIVERY TIMES
5.1 Delivery costs
Product delivery to the customer is subject to payment unless the sales agreement provides otherwise.
Product delivery costs (including transport, delivery, and postal fees) are indicated to the customer on the online store website in the delivery costs information tab and during the order process.
5.1.1 Shipping costs per product category
Shipping costs are based on product size:

Multiple items: Shipping costs are calculated per item. Ordering multiple products will incur shipping charges for each item separately.
5.1.2 What is included in delivery
Delivery includes:
- Transport to your specified delivery address
- Delivery to door (ground floor/building entrance)
- Driver assistance with unloading from vehicle
Delivery does NOT include:
- Assembly or installation services
- Carrying items upstairs or to specific rooms
- Removal of packaging materials

5.2 Delivery methods
The Seller provides the following product delivery methods:
5.2.1 Pallet shipment
Shipment on pallet via professional freight services.
5.2.2 Courier shipment
Shipment via courier services for smaller items.
5.2.3 Personal pickup
Pickup at a location agreed with the customer (if available).
5.3 Delivery time
Product delivery time to the customer is 9-16 calendar weeks, unless a shorter period is indicated in the product description or when placing the order.
For products with different delivery times, the delivery time is the longest indicated time, which however cannot exceed 16 calendar weeks.
5.3.1 Start of delivery time
The start of delivery time is calculated as follows:
For bank transfer, advance payment, electronic payment or card payment: From the date the Seller's bank account or settlement account is credited.
For cash payment: From the sales agreement conclusion date.
5.4 Acceptance of delivery
The customer undertakes to accept delivery within maximum 2 weeks of receiving relevant information about goods' readiness for delivery to the destination specified in the order.
5.5 Storage costs
If delivery is not accepted within the time specified in section 5.4, a storage fee of €5 gross for each commenced calendar day will begin to be charged.
6. PRODUCT SAFETY AND GPSR COMPLIANCE
6.1 General Product Safety Regulation (GPSR)
From December 13, 2024, all products sold by DeluxDeco comply with the EU General Product Safety Regulation (EU 2023/988). As the Responsible Person within the EU, we ensure all products are safe and comply with all applicable safety requirements.
6.2 Product information
Each product sold via our online store contains:
- Manufacturer/responsible person identification and contact details
- Product identification (type, batch or serial number where applicable)
- Safety warnings and user instructions in Dutch language
- Clear product images
6.3 Technical documentation
The Seller maintains technical documentation for all products for 10 years after placing on the market, in accordance with GPSR requirements.
6.4 Product safety complaints
If you suspect a safety issue with a product, please contact us immediately via help@deluxdeco.nl.

6.5 Chemical safety (REACH)
All furniture complies with the REACH Regulation for chemical substances. Composite wood complies with E1 classification for formaldehyde emissions (≤0.1 ppm).
6.6 Electrical products
Furniture with electrical functionality (such as adjustable positions, heating elements, or integrated lighting) complies with the Low Voltage Directive and bears CE marking where required.
7. COMPLAINT HANDLING PROCEDURE
7.1 Scope
This section 7 establishes the complaint handling procedure common to all complaints submitted to the Seller, particularly complaints regarding:
- Products
- Sales agreements
- Electronic services
- Other complaints related to Seller or online store operations
7.2 Submitting a complaint
A complaint may be submitted by the customer:

7.3 Response time
The Seller will respond to the complaint promptly, no later than within 14 calendar days from the date of its receipt.
7.4 Warranty and legal guarantee
For products purchased under a sales agreement concluded from January 1, 2023, provisions of the Dutch Civil Code Book 7 regarding conformity of consumer goods apply.
Within 2 years of delivery, it is presumed that any lack of conformity manifesting within that period existed at the time of delivery, unless proven otherwise given the nature of the product or defect.
8. OUT-OF-COURT DISPUTE RESOLUTION
8.1 Dispute resolution options
Dutch consumers have various options for out-of-court dispute resolution:
8.1.1 Disputes Committee
Consumers can submit their dispute to the Disputes Committee (Geschillencommissie) competent for their type of complaint. For furniture and home furnishings, this is:

8.2 European ODR platform

This platform is a multilingual website with a one-stop shop for consumers and businesses seeking out-of-court resolution of disputes concerning online purchases.
9. RIGHT OF WITHDRAWAL
9.1 Withdrawal period
A consumer who has concluded a distance contract may withdraw from it within 14 calendar days without giving reasons and without costs, except costs specified in section 9.7.
To meet the deadline, it is sufficient to send the declaration before its expiry.
9.2 Submitting withdrawal declaration

9.3 Returning the product
The product return as part of withdrawal from the contract may be made to:

9.4 Start of withdrawal period
The period for withdrawal from the contract begins:
9.4.1 For sales agreements
From the date the consumer or a third party designated by the consumer, other than the carrier, takes possession of the product.
For contracts covering:
- Multiple products delivered separately, in batches or parts – from taking possession of the last product, batch or part
- Regular delivery of products for a specified period – from taking possession of the first product
9.4.2 For other contracts
From the contract conclusion date.
9.5 Return costs
9.5.1 FREE return upon direct refusal
Returns are 100% FREE if:
- You notify us during delivery, AND
- Before the delivery team departs
9.5.2 Return costs after acceptance
If you have accepted the product and later decide to exercise your withdrawal right, you bear only the direct costs of returning the product.

For products that cannot be returned via regular mail (large furniture), estimated standard return costs are:
- Large items (corner sofa, 3-seater sofa): €500
- Small items (armchair, 2-seater sofa): €300
9.6 Refund
We will refund all payments made by you, including delivery costs (excluding additional costs resulting from your choice of a delivery method other than the cheapest standard delivery we offer), immediately and in any case no later than 14 days after receiving your withdrawal declaration.
We may withhold refund until we have received the product back or you have provided proof of sending it back, whichever occurs first.
9.7 Exceptions to withdrawal right
You have NO withdrawal right for:

Custom-made products – Products that are not prefabricated and are manufactured according to your specifications or serve your individual needs

IMPORTANT LEGAL NOTE: This exception applies ONLY if products are actually produced from scratch according to individual customer specifications that fundamentally alter the product's nature.
Simply choosing from available options (such as color, fabric, or standard configurations) does NOT qualify as "custom-made" under Dutch law.
Examples:
- ✅ Custom-made: Specific dimensions outside standard range, custom foam density to specification, special leather finish outside regular assortment
- ❌ NOT custom-made: Choosing from 5 standard colors, selecting fabric from catalogue, choosing between 2-seat/3-seat standard models
If products do NOT qualify as fully custom-made, the standard 14-day reflection period applies. Legal advisor consultation recommended.

Products in sealed packaging – Products that for hygiene reasons are not suitable for return and whose seal has been broken after delivery

Products inseparably connected – Products that after delivery, due to their nature, are inseparably connected to other items

Fully performed services – Services for which you gave express prior consent for commencement of performance and acknowledged you would lose withdrawal right once service fully performed
10. PROVISIONS FOR ENTREPRENEURS
10.1 Scope
This section 10 and all provisions contained herein are addressed to and thus binding only on a customer or user who is not a consumer.
10.2 Seller's withdrawal right
The Seller has the right to withdraw from the sales agreement within 14 calendar days from its conclusion date. Withdrawal in this case may occur without giving reasons and gives rise to no claims against the customer.
10.3 Warranty and conformity
The Seller's liability under warranty for the product or for non-conformity of the product with the sales agreement is excluded.
10.4 Complaint response time
The Seller will respond to the complaint within 30 calendar days from receipt date.
10.5 Limitation of liability
The service provider/Seller's liability toward the user/customer, regardless of legal basis, is limited – both as part of a single claim and for all claims in total – to the amount of price paid and delivery costs under the sales agreement, but not more than one thousand euros (€1,000).
11. PRODUCT REVIEWS
11.1 Review submission
The Seller enables customers to submit and access product and online store reviews under terms specified in this section.
11.2 Review verification
The Seller ensures published product reviews originate from customers who purchased the product. Verification occurs without undue delay.
11.3 Review authenticity
The Seller does not post or commission others to post false customer reviews or recommendations, and does not distort customer reviews or recommendations to promote products. The Seller shares both positive and negative reviews.
12. ILLEGAL CONTENT
12.1 Contact point
The service provider designates email address help@deluxdeco.nl as a single contact point enabling direct communication for Digital Services Act purposes.
12.2 Reporting illegal content
Any person or entity may report presence of specific information considered illegal content by sending email to help@deluxdeco.nl.
12.3 User obligations
Users providing content in the online store must:
- Use the online store in accordance with law and good practices
- Provide factually accurate content
- Not provide illegal content
- Not send unsolicited commercial information (spam)
13. FINAL PROVISIONS
13.1 Contract language
Agreements concluded via the online store are concluded in Dutch language.
13.2 Applicable law
For matters not regulated in these Terms & Conditions, generally applicable provisions of Dutch law apply, particularly:
- Dutch Civil Code
- Telecommunications Act
- Consumer law as implemented in the Netherlands
- Other relevant generally applicable law provisions
For consumers: Dutch consumer law applies insofar as it is more favorable than these Terms & Conditions provisions.
